Regulations

The safety register is governed by several regulatory texts:

• Article R143-44 of the Construction and Housing Code
• The order of June 25, 1980, as amended (ERP safety regulations) amended by the order of February 7, 2022.
• The Labor Code (articles R4227-38 to R4227-39) amended by the ordinance of March 12, 2007.

In the event of an inspection, the safety register must be presented upon request by the competent authorities (fire department, labor inspectorate, etc.). As specified by the Central Safety Commission since 2002, the register may be presented in a digital format, which holds the same legal value as the paper version.

If the safety register cannot be presented during an inspection or is not kept up to date, then sanctions may be applied such as:

• Criminal proceedings
