The safety register is subject to regulatory obligations defined by French law, regardless of the establishment's category, operations, or activity. It falls under the legal responsibility of owners, operators, employers, and those responsible for safety, fire safety, and accessibility. The safety register must therefore be kept rigorously in order to be produced for Safety Commissions or following an incident.
Regulations for Public-Access Buildings (ERP)
The legislative and regulatory provisions relating to the safety register for public-access buildings (ERP) are defined by the Construction and Housing Code (CCH). Since ERPs include any building receiving the public (visitors, users, customers, etc.), they encompass a wide range of establishments: shops, healthcare facilities, cultural or tourist venues, high-rise buildings, residential buildings, etc.
Under the French Construction and Housing Code (CCH), builders, installers, and operators of public-access buildings (ERP) must ensure the compliance, inspection, and maintenance of the establishment's equipment and installations. Article R*143-44 of the CCH, included in the section on safety and fire protection inspection measures, states that ERPs must have a safety register "in which the essential information for the proper functioning of the safety service is recorded" (for example, a fire safety register).
The ERP safety register must be presented during periodic inspections or unannounced visits conducted by Safety Commissions, police and/or gendarmerie services, etc.
Safety register regulations for workplaces (ERT)
In the event of a major issue (accident, fire with injuries or casualties), this is the first document that the justice system would seize to verify whether safety measures were properly applied.
Occupational health and safety rules relating to the safety register regulations for workplaces (ERT) and for personnel working in ERPs are governed by the Labor Code.
Under Articles L4121-1 to L4121-3 of the Labor Code, employers are required to ensure the safety and protect the health of workers (permanent or fixed-term employees, temporary staff, interns, etc.). In this capacity, they must ensure the inspection and maintenance of the facilities, workstations, and equipment provided to them. Employers must record the results of these checks, and although the Labor Code does not explicitly mention the safety register, Article L4711-5 authorizes them to centralize this information in a "single register" to facilitate storage and consultation.
These "certificates, instructions, results, and reports relating to the inspections and checks for which the employer is responsible under occupational health and safety" thus centralized must be kept available for the labor inspectorate, social security organizations, health and safety committees, employee representatives, the occupational physician, etc.
